1. Acceptance of Terms

By accessing or using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms, regardless of whether you are a registered member of SCKIN Club. These Terms constitute a legally binding agreement between you and SCKIN Club regarding your use of the Services.

If you are accepting these Terms on behalf of a company, organization, or other legal entity, you represent and warrant that you have the authority to bind that entity to these Terms, in which case "you" shall refer to that entity.

2. Definitions

In these Terms, the following definitions apply:

• "Account" means the account created by a User to access and use the Services.
• "Content" means any text, graphics, images, music, software, audio, video, information, or other materials appearing on or through the Services.
• "Order" means a request to purchase Products through the Services.
• "Products" means the fruits, vegetables, and other items offered for sale through the Services.
• "Subscription" means a recurring Order for Products at specified intervals.
• "User" means an individual who accesses or uses the Services.
• "User Content" means any Content that a User posts, uploads, publishes, submits, or transmits to be made available through the Services.

3. Account Registration and Use

3.1 Account Creation

To use certain features of our Services, you may need to register for an Account. When you register, you agree to provide accurate, current, and complete information and to update this information to maintain its accuracy. You are responsible for safeguarding your password and for all activities that occur under your Account. You agree to notify us immediately if you suspect any unauthorized use of your Account.

You must be at least 18 years old to create an Account and use our Services. By creating an Account, you represent and warrant that you are at least 18 years old.

3.3 One Account Per User

You may not create more than one Account without our express permission. We reserve the right to terminate any duplicate Accounts.

3.4 Account Termination

We reserve the right to suspend or terminate your Account at any time for any reason, including but not limited to violation of these Terms. You may also terminate your Account at any time by contacting our customer service.

4. Services and Membership

4.1 Service Description

SCKIN Club provides a community platform for Counter-Strike 2 enthusiasts in Poland. Our Services include, but are not limited to, forums, blogs, tournaments, events, coaching, and other community features. We reserve the right to modify, suspend, or discontinue any part of the Services at any time without notice or liability.

4.2 Membership Tiers

We offer different membership tiers, including free and premium options. Each tier provides access to different features and benefits, as outlined on our membership page. You acknowledge that premium features are only available to users who have paid for the corresponding membership tier.

4.3 Membership Fees

Premium membership requires payment of fees as specified on our website. Fees may be charged on a monthly, quarterly, or annual basis, depending on the membership plan you select. Prices for premium memberships are subject to change upon thirty (30) days' notice. Such notice may be provided by email or by posting the changes on the Services.

4.4 Automatic Renewal

Unless you opt out of auto-renewal, your premium membership will automatically renew at the end of your subscription period. You can cancel auto-renewal at any time through your account settings or by contacting customer service.

5. Content and Conduct

5.1 User Content

You retain all rights in the User Content you post, upload, publish, submit, or transmit through our Services. By making any User Content available through the Services, you grant to SCKIN Club a non-exclusive, transferable, sublicensable, worldwide, royalty-free license to use, copy, modify, create derivative works based upon, distribute, publicly display, and publicly perform your User Content in connection with operating and providing the Services.

5.2 Content Restrictions

You agree not to post, upload, publish, submit, or transmit any User Content that:

• Is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, invasive of another's privacy, hateful, or otherwise objectionable
• Infringes any patent, trademark, trade secret, copyright, or other intellectual or proprietary rights of any party
• Contains software viruses or any other computer code designed to interrupt, destroy, or limit the functionality of any computer software or hardware
• Constitutes unsolicited or unauthorized advertising, promotional materials, junk mail, spam, chain letters, or any other form of solicitation
• Impersonates any person or entity or otherwise misrepresents your affiliation with a person or entity
• Promotes illegal activities or contains information or instructions that could cause harm to others

5.3 Prohibited Conduct

You agree not to engage in any of the following prohibited activities:

• Using the Services for any illegal purpose or in violation of any local, state, national, or international law
• Harassing, threatening, or intimidating other users
• Using cheats, automation software, hacks, bots, mods, or any unauthorized third-party software designed to modify or interfere with the Services
• Attempting to circumvent any content filtering techniques we employ or attempting to access areas or features of the Services that you are not authorized to access
• Collecting or harvesting any personally identifiable information from the Services
• Copying or adapting the Services' software, including but not limited to Flash, PHP, HTML, JavaScript, or other code
• Interfering with, disrupting, or creating an undue burden on the Services or the networks or services connected to the Services

5.4 Content Monitoring and Removal

We have the right, but not the obligation, to monitor and edit or remove any User Content provided on the Services. We also have the right to terminate your access to all or part of the Services for any violation of these Terms. We assume no liability for any User Content that you or any other user or third party posts or sends through the Services.

6. Tournaments and Events

6.1 Registration and Participation

When registering for tournaments or events, you agree to provide accurate and complete information about yourself and your team. You also agree to follow all rules and guidelines specific to each tournament or event.

6.2 Tournament Rules

Each tournament has its own set of rules, which will be published on the tournament page or provided to registered participants. By participating in a tournament, you agree to abide by these rules. Failure to follow the rules may result in disqualification and, in serious cases, suspension or termination of your Account.

6.3 Prize Distribution

Prizes will be distributed as specified in the tournament rules. We reserve the right to withhold prizes if we determine, in our sole discretion, that a participant has violated the tournament rules or these Terms. Prizes may be subject to tax reporting and withholding in accordance with applicable laws.

6.4 Cancellation and Modifications

We reserve the right to cancel, postpone, or modify tournaments and events at our discretion. In the event of cancellation, we will use reasonable efforts to notify registered participants and provide refunds where applicable.

7. Payments and Refunds

7.1 Payment Methods

We accept various payment methods as indicated during the checkout process. By providing a payment method, you represent that you are authorized to use the payment method and that any payment information you provide is true and accurate.

7.2 Processing of Payments

Payments for memberships, tournament registrations, or other services are processed through our third-party payment processors. By making a payment, you agree to the terms and conditions of these payment processors.

7.3 Taxes

You are responsible for paying all taxes associated with your purchase of our Services. Prices displayed on the Services may not include taxes, which will be added to your total where applicable.

7.4 Refunds

Our refund policy varies by service:

• Memberships: Premium memberships may be eligible for a refund within 14 days of purchase if you have not used any premium features.
• Tournament Registrations: Tournament entry fees are generally non-refundable after registration closes. Refunds may be provided if a tournament is canceled by SCKIN Club.
• Other Services: Refund eligibility for other services will be specified at the time of purchase.

8. Intellectual Property

8.1 SCKIN Club Intellectual Property

The Services, including all content, features, and functionality, are owned by SCKIN Club, its licensors, or other providers and are protected by copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws. You agree not to copy, modify, create derivative works of, publicly display, publicly perform, republish, download, or store any material from our Services without the prior written consent of SCKIN Club.

8.2 Trademarks

The SCKIN Club name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of SCKIN Club or its affiliates or licensors. You may not use such marks without the prior written permission of SCKIN Club.

8.3 Third-Party Intellectual Property

We respect the intellectual property rights of others and expect our users to do the same. If you believe that content on the Services infringes your copyright, please contact us with information supporting your claim.

9. Disclaimers and Limitation of Liability

9.1 Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. SCKIN CLUB DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICES OR THE SERVERS THAT MAKE THEM AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

9.2 Limitation of Liability

IN NO EVENT WILL SCKIN CLUB, ITS AFFILIATES, OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, THE SERVICES, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, PERSONAL INJURY, PAIN AND SUFFERING, EMOTIONAL DISTRESS, LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF BUSINESS OR ANTICIPATED SAVINGS, LOSS OF USE, LOSS OF GOODWILL, LOSS OF DATA, AND WHETHER CAUSED BY TORT (INCLUDING NEGLIGENCE), BREACH OF CONTRACT, OR OTHERWISE, EVEN IF FORESEEABLE.

10. Dispute Resolution

10.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United Kingdom, without giving effect to any principles of conflicts of law.

10.2 Dispute Resolution

Any dispute arising from or relating to these Terms or your use of the Services shall first be resolved through good faith negotiations between the parties. If the dispute cannot be resolved through negotiation, it shall be submitted to binding arbitration in accordance with the rules of the International Chamber of Commerce.

10.3 Class Action Waiver

Any proceedings to resolve or litigate any dispute in any forum will be conducted solely on an individual basis. Neither you nor SCKIN Club will seek to have any dispute heard as a class action or in any other proceeding in which either party acts or proposes to act in a representative capacity.

11. Termination

We may terminate or suspend your Account and access to the Services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the Services will immediately cease. If you wish to terminate your Account, you may simply discontinue using the Services or contact us to request Account deletion.

12. General Provisions

12.1 Entire Agreement

These Terms, together with the Privacy Policy and any other legal notices or additional terms and conditions or policies published by SCKIN Club on the Services, shall constitute the entire agreement between you and SCKIN Club concerning the Services.

12.2 Waiver and Severability

No waiver by SCKIN Club of any term or condition set out in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of SCKIN Club to assert a right or provision under these Terms shall not constitute a waiver of such right or provision. If any provision of these Terms is held to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms will continue in full force and effect.

12.3 Assignment

These Terms are personal to you, and you may not assign, transfer, or sublicense your rights or obligations under these Terms to anyone without our prior written consent. SCKIN Club may assign, transfer, or delegate any of its rights and obligations hereunder without consent.
